1. القبول1. Acceptance

تنظّم هذه الشروط استخدامك لتطبيق دربونة وموقعه وخدماته («الخدمة»). بتحميلك التطبيق أو استخدامه فإنك توافق على هذه الشروط وعلى سياسة الخصوصية. إذا لم توافق عليها، لا تستخدم الخدمة. These terms govern your use of the Darbuna app, website and services (the “Service”). By downloading or using the app you agree to these terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. من يحق له الاستخدام2. Who may use the Service

يجب أن يكون عمرك [18] عامًا على الأقل، أو سن الرشد في مكان إقامتك، وأن تمتلك أهلية إبرام عقد ملزم. أنت مسؤول عن أي استخدام للخدمة من جهازك. You must be at least [18] years old, or the age of majority where you live, and able to enter a binding contract. You are responsible for any use of the Service from your device.

3. رخصة الاستخدام3. Licence

نمنحك رخصة شخصية، غير حصرية، غير قابلة للتحويل، قابلة للإلغاء، لاستخدام التطبيق على الأجهزة التي تملكها أو تتحكم بها، وفقًا لشروط متجر التطبيقات الذي حمّلته منه. هذه الرخصة للاستخدام الشخصي غير التجاري. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, subject to the terms of the app store you downloaded it from. The licence is for personal, non-commercial use.

الوصول البرمجي إلى واجهاتنا (API) مقيّد بمفتاح تطبيق ولا يجوز مشاركته أو استخدامه بشكل مفرط. Programmatic access to our API is gated by an application key and must not be shared or used in a way that overloads the Service.

4. الاستخدام المقبول4. Acceptable use

توافق على ألّا تقوم بما يلي:You agree not to:

• استخدام الخدمة بما يخالف القانون العراقي أو أي قانون ينطبق عليك.Use the Service in breach of Iraqi law or any law that applies to you.
• إرسال تقارير كاذبة أو مضلّلة عن الحوادث أو الكاميرات أو الطرق.Submit false or misleading reports about crashes, cameras or road conditions.
• مهاجمة الخدمة أو تعطيلها أو تجاوز حدود الاستخدام أو استخراج البيانات آليًا.Attack, disrupt or overload the Service, bypass usage limits, or scrape its data.
• هندسة التطبيق عكسيًا أو تعديله أو إعادة توزيعه تجاريًا.Reverse-engineer, modify or commercially redistribute the app.
• إزالة إشعارات الإسناد أو الرخص من الخرائط والبيانات.Remove attribution or licence notices from the maps and data.

5. السلامة والملاحة5. Safety & navigation

دربونة أداة مساعدة، وليست بديلًا عن حكمك على الطريق. أنت المسؤول وحدك عن قيادتك وسلامتك وسلامة الآخرين. Darbuna is an aid, not a substitute for your own judgement on the road. You are solely responsible for your driving and for the safety of yourself and others.

• التزم دائمًا بالإشارات المرورية وقوانين السير وحدود السرعة المعلنة على الطريق، وليس بما يعرضه التطبيق.Always follow road signs, traffic law and the posted speed limit — not what the app displays.
• لا تتفاعل مع التطبيق يدويًا أثناء القيادة. اضبط مسارك قبل الانطلاق.Do not interact with the app by hand while driving. Set your route before you set off.
• قد تكون الخرائط والأسعار والزحام غير دقيقة أو متأخرة. الطرق تتغيّر، وقد لا تكون كل التحويلات أو الإغلاقات موثّقة.Maps, traffic and estimates may be inaccurate or out of date. Roads change, and not every closure or turn restriction is mapped.
• تنبيهات الكاميرات والشرطة مبنية على بلاغات المستخدمين، وقد تكون خاطئة أو قديمة.Camera and police alerts are based on user reports and may be wrong or stale.

6. تقارير المستخدمين6. User reports

عند إرسال تقرير (حادث، أعمال طرق، كاميرا…) فإنك تمنحنا رخصة عالمية مجانية غير حصرية لاستخدامه وعرضه وتوزيعه ضمن الخدمة. تقرّ بأن التقرير يعكس ما لاحظته فعلًا، وأنك لا ترسل محتوى مخالفًا للقانون أو خاصًا بغيرك دون إذن. When you submit a report (crash, road works, camera…), you grant us a worldwide, royalty-free, non-exclusive licence to use, display and distribute it within the Service. You confirm that the report reflects what you actually observed and that you are not submitting unlawful content or someone else's private information without permission.

نحتفظ بحق حذف أي تقرير مخالف أو غير دقيق دون إشعار. We may remove any report that is unlawful or inaccurate without notice.

7. بيانات الخرائط والأطراف الأخرى7. Map data & third parties

تستند الخرائط وبيانات الأماكن إلى OpenStreetMap (رخصة ODbL)، وOverture Maps Foundation، وFoursquare، إضافة إلى بيانات من مستخدمين آخرين. تخضع هذه البيانات لرخص أصحابها، ويجب إبقاء الإسناد ظاهرًا عند إعادة استخدامها. Our maps and place data are built on OpenStreetMap (ODbL licence), Overture Maps Foundation and Foursquare, plus contributions from other users. That data remains under its own licences, and attribution must be kept visible when it is reused.

8. الملكية الفكرية8. Intellectual property

التطبيق واسم «دربونة» وشعاره وواجهاته وتصميمه مملوكة لنا أو لمن مانحينا، ولا تمنحك هذه الشروط أي حق فيها سوى الرخصة المذكورة أعلاه. The app, the “Darbuna” name and mark, its interfaces and its design are owned by us or our licensors. These terms grant you no rights in them beyond the licence above.

9. توفّر الخدمة والتغييرات9. Availability & changes

نقدّم الخدمة «كما هي» وقد نعدّلها أو نوقف جزءًا منها (ميزة أو محافظة أو واجهة) في أي وقت. تنزيل حزم المحافظات يعمل دون إنترنت، لكن الميزات الحيّة تعتمد على الاتصال بخوادمنا. We provide the Service “as is” and may modify it or discontinue parts of it (a feature, a governorate, an endpoint) at any time. Downloaded governorate packages keep working offline, but live features depend on reaching our servers.

10. إخلاء المسؤولية عن الضمانات10. Disclaimer of warranties

إلى أقصى حد يسمح به القانون، تُقدَّم الخدمة دون أي ضمان صريح أو ضمني، بما في ذلك ضمانات الملاءمة لغرض معيّن ودقة البيانات واستمرار التوفّر. To the fullest extent permitted by law, the Service is provided without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy of data, and uninterrupted availability.

11. حدود المسؤولية11. Limitation of liability

إلى أقصى حد يسمح به القانون، لا نتحمّل مسؤولية أي أضرار غير مباشرة أو تبعية أو عرضية، ولا أي خسارة ناتجة عن الاعتماد على الخرائط أو التوجيه أو التنبيهات، بما في ذلك المخالفات المرورية أو الغرامات أو التأخير. To the fullest extent permitted by law, we are not liable for indirect, incidental or consequential damages, or for any loss arising from reliance on the maps, routing or alerts — including traffic fines, penalties or delays.

حيث لا يجوز استبعاد المسؤولية قانونًا، تبقى مسؤوليتنا الإجمالية محدودة بأكبر مبلغ بين [ما دفعته للخدمة خلال 12 شهرًا] أو [100 دولار أمريكي]. Where liability cannot lawfully be excluded, our total liability is limited to the greater of [the amount you paid for the Service in the previous 12 months] or [USD 100].

لا شيء في هذه الشروط يحدّ من حقوقك القانونية غير القابلة للتنازل. Nothing in these terms limits any statutory rights you have that cannot be waived.

12. إنهاء الخدمة12. Termination

يمكنك التوقف عن استخدام الخدمة في أي وقت بحذف التطبيق. ويمكننا تعليق وصولك أو إنهاؤه إذا خالفت هذه الشروط أو أسأت استخدام الخدمة أو عرضتها للخطر. You may stop using the Service at any time by deleting the app. We may suspend or end your access if you breach these terms, misuse the Service, or put it at risk.

13. القانون الحاكم والتسوية13. Governing law & disputes

تخضع هذه الشروط لقوانين [جمهورية العراق] دون اعتبار لقواعد تنازع القوانين، وتختص محاكم [بغداد] بالنظر في أي نزاع. سنحاول قبل ذلك حلّ الخلاف وديًا عبر التواصل معنا. These terms are governed by the laws of [the Republic of Iraq], without regard to conflict-of-law rules, and the courts of [Baghdad] have exclusive jurisdiction over any dispute. Before that, we will try to resolve the disagreement amicably by email.

14. تغييرات الشروط14. Changes to these terms

قد نحدّث هذه الشروط. سننشر النسخة الجديدة هنا مع تاريخ محدّث، واستمرارك في استخدام الخدمة بعد النشر يعني موافقتك عليها. We may update these terms. We publish the new version here with an updated date, and continuing to use the Service after publication means you accept them.
